Creative Services Terms:
Our Creative Services are designed to bring your vision to life, and we want to make sure you understand the terms and conditions that govern our collaboration. The services provided will be considered complete upon the digital delivery of your artwork. Please note that all artwork will be delivered as un-layered files.
Each creative services project encompasses a total effort of 4 hours, which includes any necessary revisions or updates. However, Hoctra Pty Ltd reserves the right to consider additional changes made after the artwork’s delivery as part of the project scope. It’s important to clarify that Hoctra Pty Ltd retains all Copyright and other intellectual property rights in the Products, Services, and Leads worldwide.
Despite our rights, we grant you, the Customer, a non-exclusive right to copy and reproduce the Artwork in whole, partial, or adapted form for your own business purposes. Please ensure that your employees, agents, and affiliates do not attempt to duplicate or modify any portion of the Artwork, except as expressly permitted in this Agreement. Altering any part of the Artwork without explicit permission is also prohibited.
Photography & Media Services Terms:
Our Photography & Media Services are aimed at capturing your moments and creating impactful visuals. These services will be deemed complete upon the digital delivery of your media content. Please be aware that each unit of service corresponds to 1 hour of effort on our part.
Upon the successful completion of your payment, we will provide you with all media related to your order.
General Terms:
In our General Terms, we address important aspects of our working relationship:
- Indemnification: You agree to defend, indemnify, and hold Hoctra Pty Ltd harmless against any claims, actions, proceedings, losses, damages, expenses, and costs directly arising from your breach of this Agreement. This includes any legal actions or disputes related to our services.
- Use of Artwork/Media/Tools/Software: You also agree to defend, indemnify, and hold Gold Social Pty Ltd harmless against any claims, actions, proceedings, losses, damages, expenses, and costs directly arising from your use of the artwork, media, tools, or software provided by us. This indemnification ensures that any liabilities arising from the use of our work are your responsibility.
In summary, we’re here to provide you with exceptional Creative Services and Photography & Media Services, but it’s important for both parties to understand and adhere to these terms to ensure a successful and mutually beneficial collaboration.
